European Parliament presses states for recognition of same-sex marriages and unions

by on December 5, 2010  •  In Marriage

The European Parliament has adopted a resolution calling for all EU member states to engage in "the mutual recognition of the effects of civil status documents." In effect, this is a declaration that EU members should recognize the marriage certificates of same-sex couples, but not a requirement that they must do so.

The Parliament said it "strongly supports plans to enable the mutual recognition of the effects of civil status documents" and "stresses the need to ensure mutual recognition" of them. The next step in the process is for the European Commission to propose ways to achieve mutual recognition of all partnerships and marriages throughout the EU.

what is the force behind a resolution? is it united nations-style? is it some sort of a wish?
i really would love to see how this would play out given that three “biggest” west european countries + italy and practically all of the former eastern bloc are reluctant to move closer to equality.
france made a step a decade+ ago; the uk about 5 yrs ago, germany sometime ago (i dont remember exactly); italy and the eastern countries are basically anti-gay. here’s hoping the parliament can sway the big 3 and the so-called new europe and have them be a bit more like the netherlands, belgium, spain, sweden, portugal or at least recognize marriage licenses from these places as such: marriage certificates.

The resolution does nothing to force countries to adopt gay marriages or civil unions etc , it’s a rsolution to recognise a foreign civil union /marriage from anther EU country. This isn’t a gay only issue since many civil unions in the EU are open to all eg the French PACS is open to same sex partners and different sex couples… Italy , for instance, will simply have to recognise another EU civil certificate and give it the appropriate rights eg joint tax status, inheritance tax etc..Italy is not obliged to bring in its own civil union or gay marriage , it’s up them! This is a repetition of an earlier statement made by Vivianne Redding a few months ago on the free movement directive. She stated that free movement meant that you should retain your civil status when you moved to another country and you kept your rights..

@kitty: right; and i’m hoping by recognizing documents from fellow countries will nudge them closer to passing their own marriage equality bills; and that in the meantime, they’ll recognize those foreign marriage certificates as such, i.e marriage certificates.
